Judge summons Top officials for failing to execute court Decrees in Anantnag

Anantnag, Nov 7 (KNS) : In a strong move to uphold the authority of the judiciary, the Principal District Judge Anantnag, Tahir Khurshid Raina, has summoned the Commissioner Secretary of the Irrigation and Flood Control Department to personally appear before the court and explain why he should not be sent to civil prison for failing to execute multiple court decrees.

The court has also directed the Chief Engineer, Superintending Engineer, and Executive Engineer of the department to ensure their personal presence on the next hearing date. The officers have been asked to explain why the decrees pending for the last five years have not been implemented.

During the hearing of several execution petitions, Judge Raina said that while obtaining a court decree may be the easiest part of a legal battle, its execution often proves to be the most difficult.

He said the judiciary acts as a “sentinel on the qui vive” and must ensure that court orders are carried out fully so that decree-holders get their due justice.Click Here To Follow Our WhatsApp Channel

Taking serious note of the prolonged non-compliance, the court also ordered the attachment of salaries of the judgment debtors. It directed all concerned Treasury Officers to deposit the attached amounts before the court, excluding only the subsistence allowances allowed under government rules.

The case has been listed for further hearing on November 17, and all summoned officers have been instructed to be present in person.

This move follows recent directions from the Supreme Court of India, which has asked all courts across the country to dispose of pending execution petitions within six months, reinforcing the judiciary’s commitment to timely enforcement of its decisions.(KNS)
