Srinagar, Jan 5 (KNS): The PhD holders of University of Kashmir, who have completed their doctoral degrees before 2009, Monday cleared the confusion created over their eligibility for teaching jobs in higher education department in the state.
The scholars said that the JKPSC on 23-11-2015 had asked those candidates who have applied for Assistant Professorship against the notification No. 12-PSC (DR-P) of 2014, to have the MSP certificate.
The scholars said that the University of Kashmir too issued the MSP certificate to the candidates who fulfilled all the 11 regulation points which are in UGC 2009 regulation Gazette for the Minimum Procedure and awards of PhD degree.
“But recently the Secretary Public Service Commission Jammu & Kashmir said in a interview to media, when University of Kashmir implemented it in 2011, how come the said University issued certificates to those PhD holders which were registered before 2009,” they said.
They said that such a statement created confusion.
“But we want to clear it with facts. The fact is in the UGC regulation of 2009 UGC (Minimum qualifications required for the appointment and career advancement of teachers in universities and institutions affiliated to it) Regulations (3rdAmendment), it is written that those who are or have been awarded PhD in compliance of the University Grants Commission (minimum standards and procedure for award of PhD Degree), Regulation 2009 shall be exempted from the minimum eligibility of NET/SLET for the recruitment of assistant professor or equivalent positions in Colleges/Universities.
“The rule came into effect in July 2009 that those candidates WHO ARE or HAVE BEEN awarded PhD degree, even before July 2009, if they follow all the points which are in those regulations are eligible for teaching jobs.Click Here To Follow Our WhatsApp ChannelThere is no date binding whether any University/Institute has done it before 2009 or after 2009.”
“Luckily, the same regulation was implemented only in 2003 by then Vice Chancellor of University of Kashmir Prof Jalees Ahmad Tareen, who was then a member of UGC too. So these regulations were in force in other well known Universities throughout in India.”
“Even the Supreme Court of India has upheld the UGC regulation of 2009, saying said that those who are or have been awarded PhD degree as per 2009 are eligible for teaching jobs in Universities and Colleges.”
“Before issuing the MSP Certificates, the University of Kashmir issued the application forms which contained 11 points of UGC regulation. And all the PhD holders have been asked to fill up the form. The form was duly signed by four authorities of University of Kashmir like Supervisor, Head of the Department, Dean of the concerned Faculty and Dean Research, University of Kashmir. Apart from this, the applicants were asked to put a supporting information like paper published, course work report/result etc. with the application form. Only those candidates were given MSP certificate which strictly followed these 11 points of the regulation.”
“Regarding the quashing of certificate by University of Jammu, they had issued this MSP certificate for the candidates who have only 6 out of 11 regulation points as per Prof Thayagrajan Committee, which is null and void at present.
So the certificate of MSP issued to PhD holders of University of Kashmir registered before 2009 or after 2009 is valid as per UGC or SC judgment, and thus we have followed all the regulation points of UGC 2009 Gazette.” (KNS)
