Srinagar, Dec 27 (KNS): The state High Court (HC) on Tuesday quashed 34th Public Safety Act (PSA) of the Hurriyat Conference (G) senior leader and Muslim League chairman, Massarat Alam Bhat and directed his immediate release.
A Muslim League leader told KNS that the judgment about the case was reserved last week however Justice Muzaffar Hussain Attar announced the judgment today.
He said that this was 34th PSA against Massarat during his 17-years of imprisonment so far.
Masarat, who is currently languishing at district jail Kathua, is undergoing continuous imprisonment from last more than six years.
According to the court orders available with Kashmir News Service (KNS), the HC has quashed the detention order on the sole ground that the detention order was passed on one single incident, alleged against the detenue therein.Click Here To Follow Our WhatsApp Channel
“The Supreme Court ruled that even one single incident can become ground for ordering the detention of the detenue. In the case on hand, the detention order of the detenue is not declared invalid just because there was only one ground available to the Detaining Authority but it is held to be illegal in view of the elaborate discussion made in this judgment,” read the document.
