Filed writ petition in Hon'ble High Court against SEC's decision about Bandipora-A: Muzaffar Shah


Srinagar, Dec 24 (KNS): ANC Vice-President Muzaffar Shah on Thursday said that party has filed a writ petition in Hon'ble High Court against the decision of SEC KK Sharma of announcing JK Apni Party candidate a winner in Bandipora-A segment tantamounts gross violation of election norms.

According to KNS Correspondent, Addressing media persons at party headquarters in Srinagar, Shah announced the decision of filing a writ petition before the Hon’ble High Court of J&K challenging the decision of the State Election Commission declaring the Apni Party candidate successful in Bandipora-A segment after mass rigging and booth capture at Garoora A&B booths on the polling day (13th Dec 2020) under gross violations of the election rules.

He said that no action was taken on the two petitions submitted with all records to the DC Bandipora & the SEC on the polling day.

The ANC leader said a copy of the fresh petition addressed to Deputy Commissioner Bandipora as Chief election officer demanding release of CCTV footage was circulated to the media. The ANC lawyers will be moving the court in case of their demand not being met for a repoll in Bandipora-A DDC constituency if the CCTV footage is not released that clearly establishes our case of mass rigging & booth capture.

He said the people of Bandipora have chosen the Alliance Candidate Gh Mohiudin Bhat to represent them. The ANC & PAGD are expecting justice to be delivered by the Hon’ble Court.

Shah apologised to the people of Kashmir for letting the BJP win at Balahama 2 after the Peoples Alliance ANC candidate’s nomination papers were rejected hours after being found in order after thorough scrutiny procedures as per rules under EC procedure. "The BJP candidate won this seat by default in connivance with the EC officials in spite of petitions put up before the Chief returning officer of the Srinagar district. The BJP could not have dreamt of winning this seat in presence of the Peoples Alliance ANC candidate Rahi Riyaz Ahmad", he said.

Shah further stated that the Alliance could have bagged 40 odd seats more if the local workers of some parties had not indulged in the practise of putting up dummy candidates which finally damaged the PAGD chances in both Kashmir & Jammu division.
The alarming reports coming in from various areas of the valley are suggesting a gross violation of EC rules & a naked dance of democracy suggesting involvement of the administration to secure joining of Independents with BJP by offering 1 cr plus to each candidate. The BJP is crossing all norms of gross proprietary and indulging in broad day light dacoity which needs to be stopped at once. What is the source of this money & what is forcing the administration to act as mere stooges of the ruling party. A gross violation of the EC rules is being witnessed which needs to be exposed.
