Don't make sale, purchase or register any vehicle involving minors: RTO to stakeholders

Srinagar, April 28 (KNS): The Regional Transport Officer on Friday asked all the stakeholders not to make any sale, purchase or register any vehicle involving minors. 


According to an order, a copy of which lies with Kashmir News Service (KNS), RTO Kashmir stated that the act amounts to violation for section 10 of the Indian Contract Act 1872, 

The order reads that instances have come to the fore where the motor vehicle dealers have sold and registered motor vehicles in the name of minors which amounts of violation of the Section 10 of Indian Contract Act, 1872

"Under the Indian Contract Act, 1872, any sale agreement executed with a  minor is deemed void abinitio. A registered motor vehicle along with its registered owner is a legal person and in case of violation of provisos of motor vehicle laws and rules made there under, by any such vehicle invokes penal action against the owner," it reads. 

It added now, therefore, in the interest of law and justice, it is enjoined upon all the registered dealers, officials of the motor vehicle department, general public, insurance agencies and other stakeholders, not to make any sale and purchase or to register any vehicle involving a minor. (KNS)
