Execution petition disposed of; petitioner confirms receipt of dues

Bandipora, June 11 (KNS): A local court in Bandipora on Tuesday dropped contempt proceedings against the Assistant Commissioner Revenue (ACR), who is also the Collector of Land Acquisition, after the officer complied with previous court directives regarding a long-pending land compensation case.

The case, pending since December 2019, pertained to a decree passed by the court for payment of ?8.4 lakh in favour of a landowner whose land was acquired and is presently under the occupation of the Chief Medical Officer (CMO) of Bandipora.

Despite no appeal being filed against the decree, the compensation amount had remained unpaid, compelling the petitioner to move an execution petition. The court had earlier directed the CMO to deposit the amount with the Collector Bandipora, who was then required to release it in favour of the petitioner upon transfer of land title.

However, when the Collector failed to release the payment, the court, in a stern order dated May 13, 2025, directed that the salary of the ACR/Collector be withheld and asked the officer to appear in person and explain why proceedings under Sections 51 and 58 and Order 21 Rules 30 and 40 of the Civil Procedure Code should not be initiated against him.Click Here To Follow Our WhatsApp Channel
On Tuesday, the petitioner appeared in the court of the Civil Judge alongside the CMO and the ACR Bandipora. He confirmed that he had now received the full amount and expressed no further grievance, pleading for closure of the execution proceedings.

The court, presided over by Civil Judge Iqbal Ahmad Akhoon, recorded the petitioner’s satisfaction and disposed of the execution petition as "exhausted". The judge also directed the respondent to submit an undertaking before the ACR Bandipora, committing to complete the formal transfer of land title to the CMO within one week—by or before June 14. Failure to do so would make the petitioner liable to pay double the execution amount.
Consequently, the court ordered the release of the ACR’s salary, provided it had not been attached in any other legal proceedings. With compliance achieved, the court dropped further action against the ACR and consigned the case file to records. (KNS)
