Ashok Bhan writes to Amit Shah, urges him to address complexities of Kashmir

 Srinagar, Feb 15 (KNS): Senior advocate and Supreme Court lawyer Ashok Bhan Thursday appealed to Union Home Minister Amit Shah to address the complexities of Kashmir, and that the Kashmir Policy and Strategy Group stands ready to support initiatives aimed at addressing the root causes of conflict and promoting a shared vision of peace and prosperity for all Kashmiris.

"The intricacies of the Jammu and Kashmir issue have long been veiled by a dense fog of distorted historical narratives, self-serving myths, and conflicting political interests. Yet, amidst this complexity, the current government has demonstrated a sincere commitment to fostering an environment conducive to peace and progress, aiming to break the cycle of violence perpetuated by adversaries," Ashok Bhan in a letter to Home Minister said.

He said that analysts specializing in Kashmir affairs have lauded the government's policy of zero tolerance towards terrorism, coupled with initiatives for economic empowerment and extensive development efforts. "As we approach the assembly elections, the prospect of restoring legitimate democracy in Kashmir holds promise not only for the region but for the entire nation. Such a move aligns with the constitutional ethos of our country and could serve as a precursor to the envisioned concept of one nation-one election." he said.

He added in the historical and social context of the Kashmir Valley, the scars of past conflicts weigh heavily upon its people. "The fallout from the 1947 turmoil and the prolonged insurgency has resulted in the displacement of indigenous religious minorities and the senseless loss of innocent lives at the hands of non-state actors and militant groups."

"The people are victims of the 1947 conflict and the lingering aftermath of the armed insurgency that led to the displacement of the entire indigenous religious minority and the killing of innocent civilians by non-state actors, brutalised anti-people groups and other actors," the senior lawyer said.

He added, "Recognizing the urgency of addressing this plight, the Kashmir Policy and Strategy Group has tirelessly advocated for dialogue and societal healing, emphasizing the imperative of fostering peace, justice, and inclusivity in the region".

He said that the group has been conducting meetings and interactions highlighting the urgent need to end the sordid and brutal phase of societal devastation, death and destruction that has engulfed the entire South Asian region in general and Jammu and Kashmir in particular to promote peace, harmony, justice, dignity and honour of the people and build an inclusive and empowered society.

Despite significant strides in combating militancy, terrorism continues to pose a persistent challenge, fueled by external support and the grievances of a disillusioned minority. Recent incidents in Poonch, Rajouri, and Srinagar serve as stark reminders of this ongoing threat, he said.

He said that moreover, the plight of the Kashmiri Pandit community, forced into exile during the tumultuous events of 1990, remains unresolved. "The systematic ethnic cleansing perpetrated against them represents a dark chapter in Kashmir's history, recognized internationally as an act of genocide."

He said the National Human Rights Commission's condemnation of this tragedy underscores the gravity of the situation. "Yet, for three decades, the exiled Kashmiri Pandits have languished as refugees in their own country, longing to return to their ancestral homeland. The time has come for the government to demonstrate the political will and resolve necessary to facilitate their repatriation, thereby restoring the fabric of Kashmiri society and securing the region's stability."

Bhan said that addressing the generational trauma inflicted by decades of conflict is paramount to fostering reconciliation and social cohesion in Kashmir. "The Supreme Court's recent pronouncements on Article 370 emphasize the need to look towards the future, rather than dwelling on the past. A commission tasked with investigating human rights violations in the region since the 1980s offers a crucial step towards acknowledging and redressing the grievances of all affected parties," he said.

He said "As we navigate the complexities of Kashmir, it is imperative that we heed the Supreme Court's guidance and prioritize the restoration of communal harmony and respect for constitutional principles."

Bhan added that the Kashmir Policy and Strategy Group stands ready to support initiatives aimed at addressing the root causes of conflict and promoting a shared vision of peace and prosperity for all Kashmiris.

"I urge you to seize this moment as an opportunity to chart a path towards lasting peace and reconciliation in Kashmir. By embracing dialogue, inclusivity, and respect for human rights, we can pave the way for a brighter, more secure future for generations to come," he added. (KNS)
