Srinagar Sept 21 (KNS) : In an important development regarding recovery of Environmental Compensation from a construction company namely NKC Projects Pvt Ltd , the Government has informed J&K Legislative Assembly that National Highways authority of India -NHAI has been asked to recover the environmental compensation from the pending bills of the said company.

This information was revealed this information in a written starred question asked by MLA Chadoora Ali Mohammad Dar. The said company has been imposed with an Environmental compensation of Rs 3.10 Crores in February this year by J&K Pollution Control Committee-J&K-PCC which was to be deposited in 3 months .

“As per the Polluter Pays Principle -PPP formula if the said compensation money is not paid in 3 months it gets doubled and then again it gets doubled in another 3 months and so on. As on date the compensation money to be paid by the company is Rs 12.30 crore and that is still unpaid. It is also unclear whether NHAI has adhered to the communication of J&K-PCC” said Dr Raja Muzaffar Bhat the petitioner in the Shaliganga mining case

The Rs 3.10 crore environmental compensation-EC was imposed by J&K Pollution Control Committee -J&K-PCC after Supreme Court dismissed the appeal filed the erring company NKC Projects Ltd against NGTs order of banning mining in Shaliganga in 2022.

The SC dismissed the appeal and passed a detailed judgement on Aug 22nd 2026 and asked J&K PCC to take action against the violators.Click Here To Follow Our WhatsApp Channel

The responded in SC case Dr Raja Muzaffar Bhat who won this case went to J&K-PCC and sought their intervention. In February 2026, a formal Environmental Compensation-EC of Rs 3.10 crores on NKC Projects Pvt Ltd, which has now escalated to Rs 12.30 crores according to the Polluter Pays Principle - PPP formula. This is infact mentioned in the J&K-PCCs EC order as well

The Mining Department, in a written reply to a starred question by Chadoora MLA Ali Mohammad Dar, said the J&K Pollution Control Committee (JKPCC) had imposed the compensation on the firm for violating conditions of its environmental clearance while carrying out extraction from Shaliganga Nallah.

The Government said the company had not deposited the amount and had instead filed a writ petition before the High Court challenging the imposition of the environmental compensation. The matter is therefore sub judice.

“ How can Govt say matter is sub juidice when the High Court has not stayed the J&K Pollution Control Committees-J&K-PCC’s Environmental Compensation – EC order ? The amount should be retrieved by J&K Govt and NHAI as used in restoration of Shaliganga at Panzan Chadoora which has been devasted by NKC company for 1 year or more in 2021-2022” Dr Raja Muzaffar added .(KNS)
