Administration if wishes can administer oath to Waheed Para physically: HC

J&K admin has gone to great lengths to prevent Waheed from taking oath: Mehbooba Mufti
Srinagar, Jan 24 (KNS): The Jammu and Kashmir High Court today suggested the administration can seek permission and administer oath physically while staying the NIA designated court order for the virtual oath taking of detained PDP leader Waheed Parra. 

Parra was arrested on November 25 last year after he was called for questioning to New Delhi, only a day after he filed his nomination for  DDC elections and was declared winner. Later he was granted bail and later re-arrested.  Parra has yet to take oath even after emerging winner in DDC elections in Pulwama. The issue is being contested in the court.

The NIA court had initially allowed him to take oath through videoconference. However the order was stayed on January 22, 2021.
Now state Government through its counsel argued that oath can't be administered through virtual mode. 
However the stay order issued by the court of Justice Rajesh Oswal has clarified that the administration can, if it wishes so, administer oath to Parra physically after taking permission from the concerned court.
 The stay was issued after additional Advocate General, Aseem Sahni, argued that oath cannot be administered on virtual mode to any elected representative.

The next date of hearing in the case is on February 17, 2021.
Reacting on the court direction, Former Chief Minister and PDP Chief Mehbooba Mufti in a tweet said, "J&K admin has gone to great lengths to prevent PDPs @parawahid from taking oath as DDC member. Fact remains that his arrest is politically motivated as even after getting bail from NIA court he was immediately booked by CIK on vague charges. @dcpulwama"( KNS)
