J&KHC Bar Association defers election after Government asked to clear stand on Kashmir

Srinagar, Nov 10 (KNS): Jammu and Kashmir High Court Bar Association on Tuesday deferred its election after Government of J&K UT asked the group to clear stand on Kashmir as “a disputed part between India and Pakistan or an integral part of the country”.
According to Kashmir News Service (KNS), Bar Association has decided to defer its election process however no new date has been fixed yet.
“We deliberated upon the notice of Government and a unanimous decision came to fore for deferment of elections”, Advocate Mudasir told and added “No new date for the polls have been fixed yet”.
Notably the Bar Association was all set to conduct its election today, however the polls have been deferred till unmentioned date after District Magistrate Srinagar on Monday asked the body to clear its stand on Kashmir.
“Yesterday a notice from District Magistrate Srinagar was served to us wherein it was conveyed that election process within the Bar is not allowed till the body clear its stand on Kashmir as a disputed region between India and Pakistan or integral part of the country”, Advocate Mudasir told.
Yesterday, a notice sent to the Bar Association read that Jammu and Kashmir HCBA has reportedly circulated a press note convening election for various office bearers of association at Srinagar on November 10. “The JKHCBA Srinagar constitute states the following as its first objective: to find ways and means take steps for resolving the issues concerning public at large including larger issues of peaceful settlement of Kashmir dispute and for this purpose organize seminars, conventions, delegate its members to various places within and outside India to become members of other associations, bodies or forums which share common outlook with the associates,” the notice issued to the J&KHCBA had read.
“You are required to explain your position on the subject, since it is not in the consonance with the Constitution of India, whereby J&K is an integral part of the country and not a dispute; and also in conflict with the advocate’s act 1961 which governs the subject vis-à-vis administrative legal points”, it reads.
